if this person is in foster care, they are a ward of the state. the cw is not the legal guadian--at least not in my state.

this would mean that the court would need to become involved. i would have doubts about the judge agreeing just to get the child out of care. that's not the goal--sending a child home to family, reunification, is always the first goal.

my best advice would be to consult an attorney in your state who is well-versed in family law.
