Montana's Religious Hutterites Must Carry Work Comp Insurance ...

In a split decision rendered by Montana?s Supreme Court, the Hutterian Brethren Church is now required to carry workers compensation insurance for business conducted outside the community.? The Montana district court originally found in favor of The Big Sky Colony, Inc, who argued the requirement to carry workers? compensation coverage violated their rights as a religious corporation.? However, in a 4-3 decision, the Supreme Court reversed, defining the Colony as an ?employer? and it?s members as ?employees?.

The decision upholds a 2009 law passed after businesses complained they couldn?t compete with exempt religious organizations.? The Colony, who?s members do not own personal property or receive monetary compensation, but instead practice communal living, felt targeted by the law.
